Legal Services for Letting Agents

If the worst happens and a tenant defaults on rent when there is no Rent Guarantee cover in place our exclusive service allows you to obtain possession of the property via the courts, using our specialist solicitors. This is a stand-alone service and is not reliant on references being obtained at the outset. Our team will initiate legal proceedings, will help to limit the loss, remove the tenant and allow you to move on with finding a new tenant on behalf of the landlord.

What we do

Option 1 – Standard Possession

 

We will follow the standard possession procedure following expiry of a Section 8 notice. The service includes:

  • Preparation of the Possession application
  • Preparation of a Witness statement
  • Full legal instructions to an Advocate
  • Production of a statement of costs
  • Representation at the court hearing by an Advocate

This procedure allows for possession of the property plus the recovery of arrears. The cost quoted will take you to this stage where we hope that a possession order will be obtained.

Option 2 – Accelerated Possession

 

This is a simpler procedure following expiry of a Section 21 Notice (the formal legal notice which terminates the tenancy on the formal end date). The service includes:

  • Preparation of the Possession application
  • Advice from a specialist solicitor
  • Drawing up of additional legal paperwork and submission to the court

In most cases this would be decided by a judge without a hearing and would be appropriate if you were interested in gaining a possession order without recovering the arrears. This does mean that you will not be able to apply for a money judgement against the tenant.*

* In the event that further follow up services are required and there is a need to instruct bailiffs, we can provide this service at an additional cost.
